Terms of Service

These Terms of Service (the "Terms") govern your use of bearingclothes.com and any purchase you make through it. Please read them before ordering. By visiting, using or ordering from this store you agree to be bound by these Terms and by our Privacy Policy.

Who you are contracting with. This store is operated by Kovács Bence, egyéni vállalkozó (Hungarian sole proprietor), trading as BEARING, registered seat 2142 Nagytarcsa, Bartók Béla utca 2/a, 3. épület, Hungary. Tax number 92303016-1-33. EU VAT number HU92303016. Sole-proprietor registration number 62705233. Contact: info@bearingclothes.com. Full statutory details are set out in our Legal Notice. In these Terms, "BEARING", "we", "us" and "our" refer to that business.

Nothing in these Terms limits your statutory consumer rights. If you are a consumer resident in the European Union, the European Economic Area, the United Kingdom or another jurisdiction granting mandatory consumer protections, those protections apply in full regardless of anything written here. Where a clause below conflicts with a mandatory consumer right, the consumer right prevails.

1. Eligibility and your account

By agreeing to these Terms you confirm that you are at least the age of majority in your country of residence, or that you have the consent of a parent or legal guardian.

You do not need an account to order. If you create one, you are responsible for keeping your credentials secure and for activity carried out under your account. You confirm that the information you give us — including billing, delivery and contact details — is accurate, current and complete. You may not sell, transfer or license your account to anyone else.

2. Our products

We describe every product as accurately as we can, including fabric composition and measurements. Colors and finish may nonetheless appear differently on your screen depending on your device, its settings and ambient light. Screen rendering is not a defect.

Product descriptions, specifications and availability may change at any time without notice. We may discontinue any product, and we may limit quantities offered to any person, region or jurisdiction at our discretion.

Garment measurements are provided as a guide and are subject to a normal manufacturing tolerance.

3. Orders and when a contract is formed

Placing an order is an offer to buy. It is not accepted until we send you a dispatch confirmation, or otherwise confirm acceptance. An order confirmation email acknowledging receipt of your order does not by itself form a contract.

We may decline or cancel an order — for example where an item is unavailable, where a price or description was published in error, where payment cannot be verified, or where we reasonably suspect fraud or resale. If we decline or cancel, we will contact you using the details you supplied and refund any payment taken in full.

Products bought from this store are for your own personal or household use, not for commercial resale or export.

4. Prices, taxes and payment

Prices are shown in the currency you select and are exclusive of delivery charges, which are added at checkout before you pay. The price that applies is the one displayed at the moment your order is placed, as confirmed in your order confirmation.

Taxes are applied at checkout in accordance with the applicable VAT regime; see our Legal Notice for our VAT status. Orders delivered outside the European Union may attract import duties, taxes or customs handling fees in the destination country. These are set by your local authority, are not included in our prices, and are payable by the recipient. See our Shipping Policy.

Payment is taken through Shopify Payments and the other providers shown at checkout. We do not store your full card details. By submitting payment details you confirm you are authorized to use the payment method concerned.

Prices, discounts and promotions may change at any time. Where we display a reference or struck-through price, that price was genuinely charged for the product in the preceding period, in line with EU Directive 98/6/EC as amended (the Omnibus Directive) and equivalent rules elsewhere. Promotions may carry their own conditions; where those conflict with these Terms, the promotion terms govern that promotion.

5. Delivery

Delivery times, rates and thresholds are set out in our Shipping Policy, which forms part of these Terms. Delivery estimates are estimates, not guarantees.

If you are a consumer, risk of loss or damage passes to you when you — or a third party you have named, other than the carrier — take physical possession of the goods. If you are not a consumer, risk passes on hand-over to the carrier.

If we fail to deliver within the agreed period, or within 30 days where no period was agreed, you may ask us to deliver within an additional reasonable period, and if we fail to do so you may cancel the contract and receive a full refund.

6. Returns, withdrawal and legal guarantee

Our Refund Policy forms part of these Terms. It sets out our voluntary 30-day money-back guarantee and, separately, the statutory 14-day right of withdrawal available to EU and EEA consumers, together with the model withdrawal form.

Legal guarantee of conformity. If you are a consumer in the EU or EEA, we are liable under Directive (EU) 2019/771 where goods do not conform to the contract and that lack of conformity becomes apparent within two years of delivery. You are entitled to have the goods brought into conformity — by repair or replacement — or to a proportionate price reduction or termination of the contract, in the order and on the conditions set out in the applicable national law. These rights are free of charge and are in addition to our voluntary guarantee. Consumers in other jurisdictions have the equivalent rights granted by their local law.

7. Intellectual property

The BEARING name and wordmark, and the text, photography, graphics, video, layout, design and their selection and arrangement across this store, are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws.

These Terms permit you to use the store for your own personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, scrape, store or transmit any material from the store without our prior written consent. All rights not expressly granted are reserved.

Other names, logos and marks appearing on the store are the property of their respective owners.

8. Third-party tools and links

The store may give you access to tools, content or functionality provided by third parties, and may link to sites we do not operate. We provide these as they are, without warranty or endorsement, and we neither monitor nor control them.

Use of any third-party tool is at your discretion and risk, on that provider's terms. We are not responsible for the content, accuracy or practices of third-party sites, nor for any transaction you enter into with a third party. Questions or complaints about a third party's products or services should be directed to that third party.

9. Relationship with Shopify

This store is powered by Shopify, which enables us to provide it to you. Any sale or purchase you make here is made directly with BEARING. Shopify is not responsible for any aspect of a sale between you and BEARING, including any injury, damage or loss arising from products purchased. You release Shopify and its affiliates from claims, damages and liabilities arising from your purchases and transactions with BEARING. Nothing in this clause affects any mandatory statutory right you have against us.

10. Reviews and other content you submit

If you send us reviews, photographs, ideas, suggestions or other content ("Submissions"), you grant us a worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, distribute and display that content in any medium, including for marketing, unless we agree otherwise with you in writing.

You confirm that you own or have the rights to everything you submit, that it does not infringe anyone's copyright, trademark, privacy or other rights, and that it is not unlawful, misleading, defamatory, obscene or abusive. If a Submission was made in exchange for payment, product or any other incentive, you must disclose that fact — undisclosed incentivized reviews are prohibited.

We are not obliged to publish, keep confidential, pay for or respond to any Submission, and we may edit or remove content at our discretion. We do not endorse and are not responsible for content submitted by users.

11. Errors and corrections

Occasionally the store may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any such error and to change or update information, and — where a manifest pricing or description error affects an order — to cancel that order and refund you in full, even after the order was submitted.

12. Acceptable use

You may use this store for lawful purposes only. You may not use it: for any unlawful, fraudulent or malicious purpose; to breach any applicable law or regulation; to infringe our or anyone else's intellectual property rights; to harass, abuse, defame or harm any person; to transmit false or misleading information; to send unsolicited advertising or spam; or to impersonate any person or entity.

You also agree not to upload or transmit viruses or malicious code; to reproduce, resell or exploit any part of the store; to collect or track other users' personal information; to phish or pharm; to use robots, spiders, scrapers or automated data-extraction tools against the store; or to interfere with, bypass or circumvent its security or access-control measures. We may suspend or terminate access where we determine these Terms have been breached.

13. Automated agents

This clause applies where you use, enable or cause the deployment of an Agent to access or interact with this store. "Agent" means software or a service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity without direct supervision.

An Agent may access this store only if it identifies itself at all times and operates in accordance with this clause, and only where we have not asked it to refrain. We may limit, including by technical means, whether and how Agents interact with the store.

Agents must: (i) identify themselves in every HTTP/HTTPS request by including "Agent/[agent name]" in the user agent string; (ii) not conceal that access is automated, including by mimicking human interaction patterns or by completing or circumventing CAPTCHAs or comparable measures; (iii) answer truthfully any prompt asking whether the interaction is human or automated; and (iv) not circumvent any measure intended to block, limit or control automated access.

14. Termination

We may terminate this agreement or your access to the store at any time at our discretion. You remain liable for amounts due up to the date of termination. Termination does not affect any contract already formed for goods we have accepted an order for.

The following survive termination: Intellectual property, Reviews and other content you submit, Termination, Disclaimer of warranties, Limitation of liability, Indemnity, Severability, Governing law and dispute resolution, and any clause that by its nature should survive.

15. Disclaimer of warranties

Information published on this store is provided for general information only. We do not warrant that it is complete or free of error, and any reliance you place on it is at your own risk.

Except as expressly stated by us and except for the statutory rights described in clause 6, the store and everything offered through it are provided on an "as is" and "as available" basis, without representation, warranty or condition of any kind. We do not warrant that the store will be uninterrupted, timely, secure or error-free.

This clause does not apply to, and does not limit, the legal guarantee of conformity or any other mandatory consumer warranty available to you under the law of your country of residence.

16. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive or consequential loss, or for loss of profit, revenue, savings or data, arising from your use of the store or of any product bought through it.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; defective products under applicable product liability law; breach of the legal guarantee of conformity; or any other liability that cannot lawfully be excluded or limited. If you are a consumer, our liability for foreseeable loss arising from breach of contract is not excluded.

17. Indemnity

If you are acting in the course of a business — that is, not as a consumer — you agree to indemnify and hold harmless BEARING, Shopify, and our respective affiliates, officers, employees, agents, licensors and service providers against losses, damages, liabilities and reasonable legal costs payable to a third party arising out of your breach of these Terms, your violation of any law or third-party right, or your use of the store. This clause does not apply to consumers.

18. Severability, waiver and entire agreement

If any provision of these Terms is held unlawful, void or unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue in force.

Our failure to exercise or enforce any right or provision is not a waiver of it.

These Terms, together with the policies referred to in them, constitute the entire agreement between you and us in relation to your use of this store, superseding any prior agreement or communication. Ambiguities are not to be construed against the drafting party.

19. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign or transfer them, provided this does not reduce the rights you have as a consumer.

20. Governing law and dispute resolution

These Terms and any contract formed under them are governed by Hungarian law, and the Hungarian courts have jurisdiction.

If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you are habitually resident, and you may also bring proceedings in the courts of that country, in accordance with Regulation (EU) No 1215/2012 and Regulation (EC) No 593/2008.

Before going to court, please write to us at info@bearingclothes.com. Most issues are resolved quickly and directly.

Out-of-court resolution. Hungarian and EU consumers may refer a dispute to the conciliation board (békéltető testület) competent for our registered seat: Pest Vármegyei Békéltető Testület, 1055 Budapest, Balassi Bálint utca 25. IV/2. Consumers resident in another EU or EEA state, Norway or Iceland may also seek free assistance with a cross-border dispute from their national European Consumer Centre (ECC-Net). Please note that the European Commission's Online Dispute Resolution platform was discontinued on 20 July 2025 and is no longer available.

21. Changes to these Terms

The current version of these Terms is always available on this page. We may update them for operational, legal or regulatory reasons by posting the revised version here and updating the date above. Material changes will be notified as required by applicable law. Changes do not apply retroactively to orders already accepted.
